2.2 SERMLY Product Owner and Related Persons may hereunder collect various types of personal information from and about the Users, including but not limited to:
2.2.1 information provided by the Users voluntarily when creating the Account, purchasing SERMs and/or filling out request forms contained on the Website;
2.2.2 information gathered automatically by SERMLY systems, Related Persons and possibly by other parties under the circumstances prescribed herein;
2.2.3 and information additionally given by the Users to SERMLY when it is required to conform to various policies and regulations, such as “Know-Your-Customer” regulations, anti-terrorism measures, anti-money laundering issues etc.
2.3 Information provided by the Users voluntarily may comprise:
2.3.1 User’s legal name;
2.3.2 User Account name;
2.3.4 electronic mail address;
2.3.5 residence mailing address;
2.3.6 contact telephone (cell phone and/or landline);
2.3.7 information relating to the User’s payment method (fiat and/or cryptocurrency) to be used for purchasing SERMs;
2.3.8 other data which may be requested via the Account, Website forms etc.
2.4 Information gathered automatically may comprise:
2.4.1 information received by SERMLY server which may gather, but not exclusively, the User’s IP address, date and time of visiting SERMLY Website, pages accessed by the User, amount of time spent on visiting of SERMLY Website;
2.4.2 information about a device through which the User accesses SERMLY Website such as a device model, system on which the device runs, web browser of the device, network types and other identification items. Also, SERMLY may obtain the User’s location data if allowed by the User’s device;
2.4.3 metadata about the information and files uploaded by the User;
2.4.4 information gathered by cookies and beacons launched by SERMLY and stored on the Users’ devices. Cookies and beacons allow SERMLY to collect information mentioned above. SERMLY Product Owner may use Google Analytics tools or other similar tools and technologies for this aim.
2.5 Information additionally given by the Users may comprise:
2.5.1 information obtained via the User’s identification documents (via a passport or driving license);
2.5.2 tax and/or social security identification numbers assigned to the User in the country of its residence;
2.5.3 information from the User’s utility bills;
2.5.4 confirmation of origin of funds used for SERMs purchase. If the Users refuse to provide certain type of information required or additionally requested by SERMLY Product Owner, functionality of the Website, product and services accessible thereon may be impaired so that the User may not be able to access and use the latest version of the Website, such product and services and the Product Owner does not assume any liability in this regard.
Section 3. Usage of Information Collected
3.1 Personal information collected by the Product Owner and Related Persons is used for such purposes as:
3.1.1 proper operation, customization, personalization and running of the Website;
3.1.2 improvement and enhancement of the Website functionality;
3.1.3 development of new solutions, services and products within SERMLY framework;
3.1.4 promotion and marketing of newly developed solutions, services and products within SERMLY framework;
3.1.5 provision of responses, updates, information about events, meetings, arrangements, plans to the Users, communication of various notices relating to SERMLY to the Users;
3.1.6 tracking the Users’ behavior, usage statistics and preferences in connection with SERMLY, other products and services which may be developed by the Product Owner;
3.1.7 prevention of misbehavior on the part of the Users, protection of SERMLY Product Owner, its assets and property;
3.1.8 provision of this personal information to investigative and law enforcement authorities if the User is suspected of having committed any perpetrations or violations in accordance with laws of any particular jurisdiction;
3.1.9 compliance with provisions of SERMLY Terms and Conditions.
Section 4. Users’ Rights and Obligations With Respect to Their Personal Information
4.1 Users are obligated to provide correct, updated, accurate and truthful identifiable and non-identifiable personal information to the Product Owner and not to mislead the Product Owner and Related Persons about their identity, residence, origin of funds for which they purchase SERMs, but not exclusively.
4.2 Users are entitled to access, update, amend and review the personal information they voluntarily provide to the Product Owner via their Accounts or by transmitting the relevant request to the Product Owner on what personal information is retained by the Product Owner and/or Related Persons, where such personal information is stored, how it is processed, who may access such personal information and how it is protected.
4.3 Users may ask the Product Owner to delete all or some portions of personal information previously provided by them to the Product Owner, revoke their consent to processing, using, transmitting and sharing of their personal information by the Product Owner and in such case the Users may not be able to access the Website, use SERMLY’s full functionality, purchase, possess and use SERMs. Upon User’s revocation of its consent to processing, using, transmitting and sharing of its personal information by the Product Owner, the Product Owner may delete the User’s Account, cancel previous purchase of SERMs made by the User and/or deactivate the User’s eligibility to purchase, possess and use SERMs without having to compensate.
4.4 If the Website and/or SERMLY enable usage of social media buttons, the Users should be aware that such social media, depending on the User’s privacy settings on such social media, may share certain information with SERMLY and the Website when using social media buttons in conjunction with the WEbsite and SERMLY.
Section 5. Protection and Sharing of Personal Information
5.1 SERMLY Product Owner strives to make its best efforts and take diligent, grounded and weighted steps to utilize industry widely recognized and renowned technical and programming measures, in particular, encryption techniques, firewalls, data access controls, but not exclusively, to protect the personal information provided by the Users. Nevertheless, the Users are warned that no such measure is one hundred percent secure and transmission and processing of information via the Internet is not guaranteed to be secure and reliable and may result in interceptions, distortion, destruction, tampering, unauthorized amendment, deletion etc.
5.3 SERMLY Product Owner undertakes not to share with, rent or sell the Users’ personal information to any third parties for a pecuniary benefit, however the Product Owner reserves the right to share the Users’ personal information with and disclose it to:
5.3.1 its suppliers, vendors, contractors, agents, representatives and Related Persons;
5.3.2 payment gateway and banking providers;
5.3.3 law enforcement authorities, investigative bodies, or other similar bodies and persons by virtue of court ruling, judgment, service of process, subpoena, warrant, interrogatory order or other action of power, whether issued by a national authority or an international body;
5.3.4 business partners and entities which the Product Owner seeks to contract with, be acquired by or carry out other corporate transformations and conversions with where the Users’ personal information may be enlisted as the Product Owner’s asset;
5.3.5 SERMLY online public fora and chats designed for the Users’ interaction and communication with one another and with the Product Owner;
5.3.6 third individuals and entities with the aim of safeguarding, securing and protecting the Product Owner’s property, rights and assets if a particular User or Users appear to be infringing rules and policies mandated by the Product Owner or there are reasonable grounds to conclude that any infringement will occur;
5.3.7 other individuals and entities at the User’s request and direction. Despite the foregoing provisions, the Product Owner may disclose and share the Users’ personal information in an anonymised aggregated form so that no particular User cannot be identified.
5.4 SERMLY and the Website may host and run links to other websites and services, for instance, advertisers. If the User decides to follow such links, the Product Owner warns that the Users should take precautions prior to leaving any personal information on these websites and services. The Product Owner is not and will not be liable to the Users for privacy rules and policies, as well as for actions and decisions taken by the aforementioned websites and services.
Section 6. Personal Information Retention Procedures
6.1 The Product Owner retains the User’s personal information in its systems for the period the User’s Account remains active, id est not terminated either by the Product Owner or the User itself. If the User does not hold the Account with SERMLY, its personal data may, nevertheless, be retained for as long as its retention is required and necessitated by the purpose for which it was provided by the User.
6.2 Regardless of Section 6.1, the Product Owner may be required, under any applicable statutes, to extend the personal information retention term laid down in Section 6.1.
Section 7. Disclaimer of Warranties and Limitation of Liability
7.2 Users expressly consent that SERMLY Product Owner, SERMLY Team and Related Persons do not assume any liability and shall not be liable for any losses, damages, lost profits, reputation damages, damages to materials, equipment, information, software possessed by the Users, arising out of the provision of their personal information to the Product Owner, collection, processing, storage, distribution, sharing, disclosure, distortion, destruction etc. of their personal information by the Product Owner and Related Persons, whether such losses or damages are direct, indirect, punitive, consequential, incidental, exemplary, special or of any other nature and qualification as may be laid down in any particular jurisdiction of which the Users, Product Owner or Related Persons are regarded to be residents or citizens.
Section 8. Amendments and Requests
